Los caracteres de absoluta y permanente con respecto a la incapacidad del agente, establecidos en el art. 49 de la ley 5811 no implican que la incapacidad deba ser del 100%, sino que basta que la invalidez conlleve una incapacidad laboral igual o superior al 66%, ya que la indemnización no repara la minusvalía sino la marginación del mercado laboral.
