Considerando:

Que la cuestión que se suscita en las presentes causas resulta sustancialmente análoga a la examinada y resuelta por el Tribunal el 16 de setiembre de 1999 en la causa H.76.XXXIV. 'H.R., C. c/ ANSeS s/ amparos y sumarísimos", votos concurrentes, a cuyas consideraciones cabe remitirse por razón de brevedad.

Por ello, el Tribunal resuelve: declarar procedentes los recursos ordinarios deducidos por la ANSeS y revocar las sentencias apeladas con el alcance que surge de los considerandos
