The Facts.—The defendant, apparently a member of the crew of the English vessel Iddesleigh, anchored in the port of Buenos Aires, committed homicide on board the vessel and then fled ashore. He was brought for trial in an Argentine court, but contended that the Court lacked jurisdiction. At the time of the crime the Iddesleigh was in the service of the British Admiralty but was not a war vessel. It appeared that the crew was that of an “ordinary vessel of the merchant marine” and the men had to provide their own outfits. The Court of First Instance held that the plea of the absence of jurisdiction must not be allowed, since the crime was one over which the Argentine courts had jurisdiction as soon as the criminal came of his own accord into their control on shore.
