DECRETO Nº 600

Mendoza, 7 de abril de 2014

Visto el expediente Nº 1688-M-2013-01283, en el cual se tramita la ratificación del Convenio Marco de Cooperación y Asistencia Mutua y su Anexo, suscripto entre la Provincia de Mendoza, República Argentina y la Universidad de Shangai de la República Popular China en fecha 19 de abril de 2013; y

CONSIDERANDO:

Que por el citado Convenio y su Anexo, se establecen las bases y mecanismos generales bajo los cuales las partes se comprometen para realizar diversas actividades conjuntas de interés mutuo;

Que los distintos campos de cooperación, términos, condiciones y procedimientos de ejecución de cada uno de los proyectos que se implementen en el marco del presente Convenio y su Anexo, serán resueltos mediante Acuerdos Específicos entre las partes;

Que se manifiesta la voluntad de crear las condiciones que permitan el intercambio de docentes, estudiantes, investigadores, material bibliográfico y publicaciones con el propósito de fortalecer la realización conjunta de proyectos preferentemente en el área de las ciencias básicas, de la ingeniería, ciencias agrarias, estudios internacionales, artes, ciencias de la información y ciencias sociales;

Por ello, conforme con lo dispuesto por los Artículos Nros. 128 Inciso 6 de la Constitución Provincial y 124 de la Constitución Nacional, lo dictaminado por Asesoría Legal de Gobernación a fojas

15 y vta. y del Ministerio de Agroindustria y Tecnología a fojas 10/12 y 30 del expediente Nº 1688-M-2013-01283,

EL GOBERNADOR

DE LA PROVINCIA

DECRETA:

Artículo 1º

Ratifíquese el Convenio Marco de Cooperación y Asistencia Mutua y su Anexo suscripto en fecha 19 de abril de 2013, entre la Provincia de Mendoza representada por el Señor Gobernador Doctor Francisco Humberto Perez y la Universidad de Shanghai de la República Popular China, representada por el Señor Vicepresidente Profesor Zhiming Ye, por los motivos expuestos en los considerandos del presente decreto y que en fotocopia certificada forma parte del mismo.

Artículo 2º

El presente decreto se dicta ad-referéndum de la H. Legislatura Provincial y con conocimiento al H. Congreso de la Nación.

Artículo 3º

Comuníquese, publíquese, dése al Registro Oficial y archívese.

AGREEMENT ON COOPERATION AND MUTUAL ASSISTANCE

BETWEEN

THE GOVERNMENT OF THE PROVINCE OF MENDOZA OF THE

ARGENTINE REPUBLIC AND

SHANGHAI UNIVERSITY

Between the Province of Mendoza, represented by the Governor, Francisco Pérez, hereinafter "the Province", and the Shanghai University, represented by the Vice President, Zhiming Ye, hereinafter "The University"; jointly the "Parties", agree to enter into this Cooperation Agreement, which is governed by the following clauses:

First: The objective of this collaboration and reciproca) assistance agreement is to establish the general basis and mechanisms under which the parties agree to carry out various joint activities of mutual interest.

Second: The various fields of cooperation, as well as the terms, conditions and the execution procedures of each one of the projects that is implemented in the framework of this agreement, shall be established by means of specific agreements between the parties. For such purposes, the previously mentioned specific agreement should establish the description of the project and of its objectives, the academic units responsible for execution, conditions, financing, execution time frame, obligations of the parties, and in general, all the clauses that are deemed necessary for it to be carried out.

Third: The parties agree to create the conditions that allow for the exchange of teachers, exchange of students, exchange of investigators and of bibliographic material and publications, integrated investigation projects, jointly supervised thesis and joint publications for the purpose of strengthening the joint execution of projects preferably in the area of basic sciences, engineering sciences, agricultural sciences, international studies, arts, information sciences and social sciences.

Fourth: The parties respectively designate as their own point of connection, Shanghai University Party, the Dean of Academic Affairs Office and insofar as the Province of Mendoza, the Director of the Investment Promotion Agency. They will propose, the manner of selecting the projects and their corresponding evaluation. Likewise, they shall be in charge of promoting inside of their institutions adequate and productiva participation of the scholars and students that act in the framework of this Agreement.

Fifth: This Agreement does not imply an expenditure commitment by the parties. Each project or activity agreed to in the Annex to this Agreement shall be assigned and implemented by means of Complementary Agreements and shall be independently financed, according to the availability of resources. The resources necessary for the implementation of these projects or activities shall be negotiated, by initiative of the coordinators of the programs, and shall have the institucional support of the universities involved.

Sixth: Once this Agreement is signed, the parties shall make known to the appropriate national authorities of its content, within the framework of its legal or statutory

obligations.

Seventh: This Agreement is valid for a period of three (3) years and shall be automatically renewed for equal periods, unless one of the parties notifies the other in writing at least three (3) months beforehand of its desire to termínate the agreement. Three counterparts of this Agreement shall be signed (1 in spanish, 1 in chinese, and 1 in english), each one of the parties shall keep two copies (one in each language).

Eighth: For all purposes under this Agreement the following shall be the legal domiciles of the parties:

ON COOPERATION AND MUTUAL

ASSISTANCE

ACADEMIC AND PROFESSIONAL MOBILITY PROGRAM

The Government of Mendoza, Argentina, represented by Governor of Mendoza Francisco Perez, with the address Peltier 351, fourth floor, main body, Mendoza, Argentina.

The Shanghai University, China, represented by Zhiming Ye with the address No.99 Shangda Road, Baoshan district, Shanghai, PR China

These two panties agree to the following:

  1. BACKGROUND

    The Mobility Program is designed to establish, develop and strengthen relations of cooperation in the field of higher education between the two institutions.

    Mobility and exchanges are an essential mechanism for this purpose within the framework of the processes in which the Government and the University are bolstered by exchange with other different realities in orden to train professionals so they can develop their skills in an international cultural environment.

  2. OBJECTIVES

    Provide regular participating university students with the opportunity to study and/or intern abroad, either in the province of Mendoza for Chinese students or in the city of Shanghai in the case of university students from Mendoza. These studies...
