The Facts.The accused, Carlos Rodrguez and Salvador Ardetes, were charged with fighting within the premises of the American Embassy at Buenos Aires. They were both in the domestic service of the Embassy. The question arose whether the ordinary courts could assume jurisdiction over this case. In the opinion of the Fiscal of this Court, the case did not fall within the category of cases exempted from the ordinary criminal jurisdiction by public international law or by municipal law.

Held: that the ordinary courts had jurisdiction over a case involving domestic servants of an embassy.
