Mariano Costa, an Italian national, appealed against an order made by the Court of first instance for his extradition to Italy on a charge of swindling (estafa agravada), pleading that under the terms of the Extradition Treaty of June 16, 1886, between Argentina and Italy, he could not be surrendered because swindling was not listed among the extraditable offences. The Treaty did list, however, the offence of fraud (estelionato).
