Resumen: El presente artículo busca aportar una reflexión sobre

dos recientes sentencias de la Corte Suprema de Justicia de la

Nación en materia de relaciones colectivas de trabajo: “APSAI”

y “Romero”. Analizaremos ambas sentencias, en sus diferentes

instancias, hasta arribar a la decisión de la Corte Suprema. Es-

timamos que ambas sentencias, dentro de sus tendencias juris-

prudenciales, vienen a complejizar aún más el panorama de trata-

miento de diversas temáticas neurálgicas sobre las asociaciones

sindicales de trabajadores/as y sus representantes. En la primera

sentencia, trataremos la retención de cuotas sindicales por parte

de las asociaciones simplemente inscriptas y en la segunda, abor-

daremos la tutela sindical de los representantes gremiales. Como

conclusión preliminar, podemos aseverar que la Corte mediante

distintos tecnicismos y apreciaciones del caso en concreto, ha

dado nuevos giros en materia de relaciones colectivas, mediante

la negación de, a su vez, tendencias decisorias de otros años. Si

bien se trata de casos muy específicos, es sabido que los fallos del

Máximo Tribunal son influyentes para otras instancias judiciales, a

la vez que instalan estándares en la misma instancia extraordina-

ria, y de ahí la importancia en su análisis.

Abstract: This article seeks to provide a reflection on two recent

judgments of the Supreme Court of Justice of the Nation in mat-

ters of collective labor relations: “APSAI” and “Romero”. We will

analyze both sentences, in their different instances, until we arrive

at the decision of the Supreme Court. We believe that both judg-

ments, within their jurisprudential tendencies, further complicate

the panorama of treatment of various neuralgic issues regarding

workers’ trade union associations and their representatives. In

the first sentence, we will address the withholding of union dues

by simply registered associations and in the second, we will ad-

dress the union protection of union representatives. As a prelimi-

nary conclusion, we can assert that the Court, through different

technicalities and appraisals of the specific case, has taken new

turns in the matter of collective relations, by denying, in turn, deci-

sion-making tendencies from other years. Although these are very

specific cases, it is known that the rulings of the Highest Court are

influential for other judicial instances, at the same time that they

establish standards in the same extraordinary instance, and hence

the importance in their analysis.
