Diplomatic Representatives — Functions of — Title to Property of Nationals of Sending State.

The Facts.—The Chargé d'Affaires and head of the diplomatic mission of Poland in Argentina sought to obtain a large sum of money deposited in Argentina on account of lumber sold by a private Polish company, under some control of the Polish Government, before the German occupation of Poland in September 1939. The petition was denied in the Court below. The Chargé d'Affaires appealed.

Held: that the appeal must be dismissed. It was not demonstrated that a minister plenipotentiary (in Argentina by courtesy of a diplomatic fiction since there is now no Polish Government in possession of territory) accorded recognition by the Argentine Government, had therefore such power of representation as extends to the faculty of appearing before the courts on behalf of private...
